Terms of Service

1. Acceptance of Terms

By accessing or using ClipStorm AI (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Service. These Terms constitute a legally binding agreement between you and ClipStorm AI (“we,” “us,” or “our”).

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes.

2. Description of Service

ClipStorm AI is an AI-powered content repurposing platform. You can upload long-form video, podcast, or webinar content, and the Service automatically generates short clips, social media posts, email content ideas, hooks, and thumbnails optimized for platforms such as TikTok, Instagram, and LinkedIn.

The Service is provided on a subscription basis. Features available to you depend on your current subscription plan. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. User Accounts and Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By creating an account, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

You may not create an account on behalf of another person without their authorization, or create multiple accounts to circumvent subscription plan limits.

4. Acceptable Use

You agree not to use the Service to:

• Upload, process, or distribute illegal content of any kind.
• Upload content for which you do not hold the necessary rights, licenses, or permissions — including content owned by third parties without their explicit authorization.
• Violate any applicable local, national, or international law or regulation.
• Infringe the intellectual property rights of others.
• Harass, abuse, threaten, or harm any person, or upload content that is defamatory, obscene, or hateful.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse-engineer, decompile, or disassemble any portion of the Service.
• Use automated tools (bots, scrapers, etc.) to access the Service in a manner that exceeds normal usage or degrades performance for other users.

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. Uploaded Content

You retain full ownership of all content you upload to the Service (“Your Content”). By uploading content, you grant ClipStorm AI a limited, non-exclusive, royalty-free license to process, analyze, and transform Your Content solely for the purpose of delivering the Service to you — including generating clips, social posts, email ideas, thumbnails, and captions.

We do not claim ownership of Your Content, sell it to third parties, or use it to train AI models beyond what is necessary to provide the Service to your account. Your Content is processed and stored only as long as required by your subscription and in accordance with our Privacy Policy.

You are solely responsible for ensuring you have the rights to upload and process any content you submit to the Service.

6. Subscription Plans, Billing, and Auto-Renewal

ClipStorm AI offers the following subscription plans:

• Free: 3 clips per month, limited features.
• Pro: $29 USD per month — unlimited clips, video exports, captions, all social posts, and email campaigns.
• Agency: $99 USD per month — includes all Pro features plus bulk generation and team workspace capabilities.

Paid subscriptions are billed on a monthly basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Billing is handled by our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

We reserve the right to change subscription prices with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new price.

7. Cancellation and Refund Policy

You may cancel your subscription at any time from your account billing settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date.

We do not provide refunds for the current billing period upon cancellation. Partial period refunds are not issued. If you believe you were charged in error, please contact us at team@clipstorm-ai.madethis.app within 14 days of the charge.

8. Intellectual Property

ClipStorm AI and its underlying technology, software, branding, user interface, and all associated intellectual property are owned by ClipStorm AI and its licensors. Nothing in these Terms transfers any ownership of our intellectual property to you.

You own all original content you upload and the outputs generated from your content (clips, posts, email ideas, etc.), subject to any underlying rights held by third parties in content you did not create yourself. You are responsible for confirming you hold rights to use and distribute any generated outputs.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ClipStorm AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service.

Our total cumulative liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amounts you paid to ClipStorm AI in the 12 months preceding the claim or (b) $50 USD.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada and the applicable federal laws of Canada, without regard to conflict of law principles. For users in the United States, these Terms are also subject to applicable US federal law. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction in Ontario, Canada, unless prohibited by applicable law.
